Federal Officials Insists Removal of Transgender Topics from Sexual Health Curricula, Multiple States Agree

At least eleven jurisdictions and a pair of regions have agreed to a new directive from the federal government to remove references of transgender issues and the presence of trans and non-binary people from a national sex education initiative, authorities confirmed.

The administration established a recent cutoff for removing these references, warning the loss of substantial government funding. Nearly all of the complying states have GOP-led state legislatures and predominantly GOP state leaders.

Legal Challenges and Financial Disputes

An additional sixteen jurisdictions and the nation's capital have initiated legal action challenging the administration's demand, arguing it infringes on Congressional authority, which created the $75 million sex education program, known as the PREP initiative.

All states involved in the legal challenge are governed by Democratic state executives.

In a recent court order, a federal judge blocked the HHS agency, which manages Prep, from withholding financial support to the Democratic states if they do not adhere.

“The agency does not demonstrate that the updated requirements are justified, let alone offer any reasonable explanation, other than pretext, for its decisions,” wrote Ann Aiken, a U.S. district judge in Oregon. “HHS provides no evidence that it made factual findings or considered the statutory objectives.”

Program Goals and Federal Review

Prep seeks to educate adolescents on healthy relationships and how to prevent unplanned parenthood and the transmission of sexually transmitted infections.

In the spring, the Trump administration demanded all jurisdictions receiving program money to provide a version of their curriculum to HHS and its subsidiary, the ACF office, for a “medical accuracy review”.

By late summer, the government dispatched notices to 46 states and territories, informing them that, during the review, it had discovered “content in the educational programs that deviate from the scope of the program's legal framework.”

Specifically, the administration claimed it had uncovered evidence of “gender ideology,” a phrase often used by conservative groups to describe the notion that identity is a changeable social construct and that transgender individuals are real.

Specific Examples of Requested Changes

The administration instructed Illinois to remove a curriculum that stated: “Adolescents may express themselves in ways that don’t conform with their biological sex.”

It instructed North Carolina to delete a line from a educational module that stated: “Individuals regardless of identity need to know how to avoid pregnancy and STDs.”

Additionally, sex educators in many jurisdictions could no longer be told to “show tolerance and understanding for all students, regardless of individual traits, including race, heritage, faith, social class, sexual orientation or identity,” according to the notices sent to jurisdictions.

Official Statements and Jurisdictional Reactions

“Oversight is imminent,” said Andrew Gradison, acting assistant secretary of the Administration for Children and Families, in a statement. “Government money will not be used to negatively influence of the next generation or advance dangerous ideological agendas.”

Several states and territories confirmed they would remove the references or had already done so. These consist of eleven specific states, as well as the U.S. Virgin Islands and the Northern Mariana Islands.

Two other states, Alabama and South Dakota, reported their Prep curricula never contained the language referenced in the administration’s letters.

Impact on Youth and Psychological Well-being

Together, these jurisdictions are inhabited by more than 120,000 trans people aged 13 to 17, based on estimates from a university department.

“When the aim is to support youth and give them a secure environment, I’m not sure why we are stomping on the at-risk teenagers in the community,” commented Cindi Huss, who leads Rise that offers health instruction in one state.

“If authorities state that there’s something incorrect about you and the educators aren’t allowed to provide information or they have to out you to your parents – when you know that that’s not safe – that’s horrible for mental health.”

Almost 50% of trans and non-binary youth contemplated self-harm in the previous twelve months, according to a 2024 survey from a mental health organization. School support for these youths is associated with lower rates of self-harm attempts, the organization found.

Earlier Incidents and Ongoing Disputes

Earlier this year, the federal government instructed California to remove mentions to transgender topics from its educational program.

When the Democratic-led state declined, the government withdrew its funding, cutting approximately $12m in government money and stopping sex education programs in educational institutions, youth centers and care facilities.

The state agency is challenging the withdrawal. To date, it has been unsuccessful in make up for the lost funding.

The government has also informed instructors who obtain funding from additional national programs, the $50 million Sexual Risk Avoidance Education (SRAE) and the $101 million TPPP initiative, that they cannot teach about “gender ideology.”

An recent judicial ruling blocked the government from altering TPPP, while the Monday court order prohibits it from changing SRAE in the suing jurisdictions that challenged the initiative.

The ACF office did not immediately respond to a inquiry.
